What a Missouri motorcycle case is worth comes down to a handful of things, and the first of them is how badly you were hurt. A rider has no frame around them, so the injuries that come out of these crashes tend to be the expensive kind: surgeries, hardware, months of rehabilitation, work you cannot go back to. The second is fault, because Missouri reduces your recovery by whatever share of it gets assigned to you, and insurers assign a great deal of it to riders. The third is how much insurance exists to pay the claim. Below is what goes into the valuation of a Missouri motorcycle claim, where the numbers usually come from, and what tends to separate a claim that settles well from one that does not.

Hit and Run Motorcycle Accidents in Missouri

Missouri is making progress on roadway safety, but motorcycle riders remain among the state’s most vulnerable travelers. Preliminary Missouri Department of Transportation data shows 911 people died on Missouri roads in 2025, while 131 motorcyclists lost their lives statewide.

For motorcyclists, a hit and run can be especially overwhelming. One moment you’re on the road; the next, you’re dealing with serious injuries, mounting medical bills, and a damaged bike. However, a driver leaving the scene doesn’t mean you’re out of options. Missouri law provides several potential pathways to compensation, even when the at-fault driver cannot be identified.

At Buchanan, Williams & O’Brien, our experienced Missouri motorcycle accident lawyers bring more than 40 years of experience representing injured individuals and working families across Missouri. From Joplin to St. Louis and communities in between, we know how Missouri courts, insurers, and adjusters evaluate these claims.

What Makes Hit and Run Motorcycle Accidents Different?

Hit and run motorcycle cases are handled differently from standard injury claims because insurance coverage becomes more complex when the at-fault driver flees the scene.

Several Pathways to Compensation

Missouri law provides several pathways to compensation depending on the circumstances of the crash:

  • Uninsured Motorist (UM) Coverage. Covers bodily injury when the driver responsible for the crash cannot be identified, including medical expenses, lost wages, and pain and suffering up to the policy limit. Missouri does not require physical contact between vehicles for a UM claim, a distinction that matters in sideswipe or forced-off-the-road incidents common in motorcycle hit and runs.
  • Underinsured Motorist (UIM) Coverage. Applies if the driver is later identified but carries insurance insufficient to cover the full extent of the injuries, covering the difference between the at-fault driver’s policy limit and the actual damages, up to the injured rider’s own UIM limit.
  • Medical Payments Coverage (MedPay). Pays medical expenses regardless of fault, up to the policy limit, and can apply while a UM or UIM claim is still pending.
  • Health Insurance. May cover treatment costs while a UM or UIM claim moves forward, though most health insurers hold subrogation rights and can seek reimbursement from any later settlement or award.
  • Third-Party Claim. Becomes available if the driver is later identified through witness statements, surveillance footage, or a law enforcement investigation.

What Factors Affect a Motorcycle Accident Settlement?

A fair motorcycle accident settlement should reflect the full harm caused by the crash, not just the first round of medical bills.

Insurance companies often focus on minimizing payout. Your claim should focus on the evidence for factors including:

  • Medical expenses, including emergency care, surgery, therapy, and future treatment
  • Lost income and reduced earning ability
  • Pain, suffering, emotional distress, and loss of normal life
  • The severity and permanence of your injuries
  • Helmet use, visibility, speed, and other disputed fault issues
  • Damage to your motorcycle and gear
  • Available liability, uninsured, or underinsured motorist coverage
  • Whether the driver was distracted, impaired, speeding, or failed to yield

Medical records, crash reports, photos, witness statements, and wage records can help show and prove your claim’s full value, but you don’t have to gather that evidence alone.

BWO brings decades of trusted advocacy to serious injury cases, combining personal attention with the preparation needed to pursue powerful results.

How Does Missouri Comparative Fault Affect Your Settlement?

Missouri adopted comparative fault in Gustafson v. Benda, a case involving a motorcycle and automobile collision.

Since that decision, Missouri follows a pure comparative fault system, which means that you may still recover compensation even if you are partly at fault, but your recovery can be reduced by your percentage of fault.

For example:

  • If your damages are valued at $200,000 but you are found 20% at fault, your recovery may be reduced to $160,000
  • If you are found 50% at fault, the recovery may be reduced to $100,000

This is especially important in motorcycle cases because insurers may try to blame the rider. They may argue that you were speeding, riding too fast for conditions, or not visible enough. Do not assume those arguments are true. A strong investigation can challenge unfair blame and protect the value of a motorcycle accident settlement.

After a motorcycle accident in Missouri, you need to remember: Fault is not always as clear as the insurance company makes it sound.

How Do Insurance Policy Limits Affect Recovery?

Even when Missouri motorcycle accident damages are serious, insurance policy limits can affect how much money is available.

Missouri’s minimum auto liability coverage is $25,000 per person for bodily injury, $50,000 per accident for bodily injury, and $25,000 for property damage. Those minimum limits may not cover a serious motorcycle injury.

That is why an attorney will look for every possible source of recovery, including:

  • The at-fault driver’s liability insurance
  • Your uninsured or underinsured motorist coverage
  • Commercial policies, if a business vehicle was involved
  • Additional negligent parties, such as a vehicle owner, employer, or roadway contractor

BWO reviews coverage, liability, medical evidence, and long-term losses so you can make informed decisions. No attorney can promise a result, but the right legal team can help you avoid settling too soon.
