We represented the surviving widow in a medical negligence claim for failing to diagnosis and treat her husband’s cancer. Our client’s husband had routine surgery scheduled and a preoperative x-ray showed her husband had x-ray findings suggesting cancer. The doctors and hospital did not tell the couple about the possible cancer shown on the x-ray. They did not learn about the x-ray until the cancer had progressed and become inoperable, and her husband tragically passed away. At first neither the doctors or the hospital took responsibility, but after complete discovery and many depositions, the case settled for $650,000. The applicable medical malpractice law capped the damages that could be recovered in the case. The settlement gave the client almost all the possible recovery allowed by law.
